Draft Constitution of Valle Niasmor

This constitution, by the authority of the people of Valle Niasmor, establishes the constitution of the Autonomous Municipality of Valle Niasmor.

The aims of this entity are:

• The upholding of sapient rights within and without
• Creating a community that works as a collective to provide for the needs of all
• Facilitate the betterment of conditions of all citizens and residents
• Facilitating the cooperation of all entities contained within it
• The enrichment of all via the sharing of individual skills
• The upholding of justice for all community members

• Does not provide procedure for picking a jury
• Does not specify the role of election officer
• Doesn't forbid bills of attainder
• No explicit rights to
  • trial by jury or due process
  • protection from arbitrary search, seizure, or forfeiture
• Doesn't specify what roles would conflict, if any.
• Does not define how the law is enforced

Everyone is free to become a resident by living within the boundaries of Valle Niasmor.

Citizens are either residents or ex-residents who have or have had their main residence in Valle Niasmor.

Any citizen may revoke their own citizenship whenever they wish.

For votes where the result is yes/no there are three possible votes for each voter: “yes”, “no”, and “don't care”. An absentee voter may either count as a “no” or “don't care”, depending on conditions of the vote.

Every vote has to be accessible, and must be announced.

A vote must remain open for a minimum of one week, unless an applicable majority is achieved before that time.

A resident or citizen may ask to be registered as an active voter. This means that their absence in votes would normally count as “no” (unless overridden by the rules of that specific vote).

A resident or citizen can only be taken off of the active voter register if they either ask to be, or if they disappear without means of contacting them for over 2 weeks.

Alternatively any resident or citizen may ask to be registered as inactive. This means that their non-participation in votes will always count as “don't care”.

Laws can be added or removed or modified in any way with a public vote. Any resident or citizen may propose a law. There must be an attempt to inform all non-inactive voters before voting can take place.

To change a law the vote must show at least 1/2 support. Individual laws can (at the option of the person introducing the law) require higher levels of support to pass (but modification or removal still can be done with 1/2 support). Laws can also allow themselves to be repealed with less than 1/2 support.

Laws should not violate the constitution. If a law conflicts with or contradicts with the constitution, then the constitution takes precedence.

This constitution may be changed in any way with a referendum. It requires at least 2/3 support of residents and citizens. A referendum for changing the constitution can only be called for by passing of a law.

Trials should be independent of the government. They should be done by having a jury selected from citizens and residents who are not the parties of the trial, and are ideally as disconnected from the parties as possible. Competent members of the jury should be involved in the administration of the trial.

Valle Niasmor must ensure these sapient rights. They may pass laws in order to do this.
